Nectar + Notes: Healing Notes & Honey Quotes for Conscious Living & Awareness (“we,” “our,” or “us”) respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (“DMCA”), we will respond expeditiously to claims of copyright infringement committed using our website.
Copyright Infringement Notification
If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible on our website, please notify our designated DMCA agent as specified below.
Required Information for DMCA Takedown Notice
For your complaint to be valid under the DMCA, you must provide the following information in writing:
- Identification of the copyrighted work that you claim has been infringed, or if multiple copyrighted works are covered by a single notification, a representative list of such works
- Identification of the infringing material that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material (including the specific URL where the material appears on our website)

- A statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner’s behalf
- Your physical or electronic signature

Notice Requirements
- DMCA notices must be sent in writing (email is acceptable)
- All required information must be included for the notice to be valid
- Incomplete notices may not be processed
- False claims may result in liability for damages under Section 512(f) of the DMCA
Counter-Notification Process
If you believe that your content was removed or disabled by mistake or misidentification, you may submit a counter-notification to our DMCA agent.
Required Information for Counter-Notification
Your counter-notification must include the following information:
- Your physical or electronic signature
- Identification of the material that has been removed or disabled and the location at which the material appeared before it was removed or disabled
- A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification
- Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or Arkansas if your address is outside of the United States), and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person
Counter-Notification Process
- Submit your counter-notification to our designated DMCA agent
- We will provide a copy of the counter-notification to the original complainant
- If the complainant does not file a court action within 10-14 business days, we may restore the removed content
Repeat Infringer Policy
We will terminate user accounts and access to our website for users who are repeat infringers of copyrighted material.
What Constitutes a Repeat Infringer
- Users who have received multiple valid DMCA takedown notices
- Users who repeatedly post content that infringes on others’ copyrights
- Users who ignore our copyright policies and continue infringing behavior
Enforcement
- First violation: Warning and content removal
- Second violation: Temporary account suspension
- Third violation: Permanent account termination
Misrepresentation
Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability for damages.
This includes:
- False claims of copyright ownership
- False claims that content is infringing
- Bad faith takedown notices
Our Response Process
Upon Receiving a Valid DMCA Notice
- Acknowledgment: We will acknowledge receipt of your DMCA notice
- Review: We will review the notice for completeness and validity
- Action: If valid, we will expeditiously remove or disable access to the allegedly infringing material
- Notification: We will notify the user who posted the content about the removal
- Documentation: We will maintain records of DMCA notices and actions taken
Timeframe
We aim to process valid DMCA takedown notices within 2-3 business days of receipt.
False Claims
We take false DMCA claims seriously. Making false claims may result in:
- Legal liability under Section 512(f) of the DMCA
- Blocking of future DMCA notices from the claimant
- Reporting to relevant authorities if appropriate
Limitations
What We Will Remove
We will remove content that clearly infringes on valid copyrights, including:
- Unauthorized reproduction of text, images, or other copyrighted materials
- User-uploaded content that violates copyright
- Comments or reviews containing copyrighted material
What We May Not Remove
- Content that falls under fair use
- Content where copyright ownership is disputed
- Factual information that cannot be copyrighted
- Content with expired copyrights
Educational Use and Fair Use
We recognize that some uses of copyrighted material may be protected under fair use or other exceptions to copyright law. We will consider these factors when evaluating DMCA notices.
International Copyright
While we operate primarily under US copyright law, we respect international copyright treaties and will consider valid complaints from international copyright holders.
